  • Terms and Conditions (also referred to as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Website regarding the use of the Service.

  • Website refers to Wiseros, accessible from https://wiseros.com

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These Terms govern Your use of the Service and the agreement between You and the Website. By accessing or using the Service, You agree to be bound by these Terms. If You disagree with any part of these Terms, You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

Nature of Our Service — Not a Real Estate Broker or Agent

Wiseros is a referral and information platform only. We are not a licensed real estate broker, real estate agent, or mortgage broker, and we do not act as one. We do not represent buyers, sellers, or any party in a real estate transaction.

Our Service connects home buyers who are seeking cashback realtors with independent, third-party licensed real estate professionals. We do not participate in, negotiate, or facilitate real estate transactions, and we do not receive any commission, referral fee, or other compensation from realtors or real estate transactions.

No Responsibility for Realtor Services

Any Realtor You are connected with through our Service is an independent professional who operates entirely separately from Wiseros. We make no representations, warranties, or guarantees regarding:

  • The quality, accuracy, or suitability of any Realtor’s services
  • The amount of cashback or rebate any Realtor may offer or provide
  • The Realtor’s licensing status, credentials, or professional conduct
  • The outcome of any real estate transaction you enter into with a Realtor
  • Whether a cashback rebate is permissible under your specific loan type or applicable state law

You are solely responsible for evaluating and selecting any Realtor you choose to work with. We strongly encourage You to independently verify a Realtor’s licensing, experience, and rebate terms before entering into any agreement.

No Guarantee of Cashback or Rebate

While our Service is designed to help You find Realtors who offer cashback or buyer rebates, we do not guarantee that any specific rebate amount will be available, offered, or paid. Rebate terms are set entirely at the discretion of the individual Realtor and may be subject to lender approval, state regulations, or other conditions.

Our Service may contain links to third-party websites or services that are not owned or controlled by the Website. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Website or its affiliates be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of or in any way related to:

  • Your use of or inability to use the Service
  • Any real estate transaction you enter into as a result of using the Service
  • The acts, omissions, or conduct of any Realtor introduced through the Service
  • Any cashback or rebate that is not received or is less than expected

”AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” without warranty of any kind. The Company expressly disclaims all warranties, whether express, implied, statutory or otherwise, including all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Governing Law

The laws of the United States, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Website.

Severability and Waiver

If any provision of these Terms is held to be unenforceable or invalid, it will be modified to accomplish the objectives of that provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
